Asiakas on ollut sijoitettuna Lumiar Oy:n Solinassa jo dynaamisen hankintajärjestelmän (492908 / Lastensuojelun ostopalvelujen hankintajärjestelmä) kilpailutuksen aikaan. Sijoituksessa on tullut lyhyt katko ja uuden sijoituksen aikaan paikka ei ole ollut enää dynaamisen hankintajärjestelmän piirissä. Lapsen edun mukaista on jatkaa asumista hänelle tutussa paikassa.
Hankintayksikkö voi tehdä suorahankinnan yksittäisissä tapauksissa hankintalain 12 luvun 110 §:n mukaisissa sosiaali- ja terveyspalveluhankinnoissa, jos tarjouskilpailun järjestäminen olisi ilmeisen kohtuutonta ja erityisen epätarkoituksenmukaista lapsen kannalta merkittävän hoito- ja asiakassuhteen turvaamiseksi. Hankinnan ennakoitu kokonaisarvo 409 050 eur (alv 0 %) ylittää kansallisen kynnysarvon.
Ennakoitu kokonaisarvo on laskettu sopimuskauden ajalle 33,1 kk. Hankinta on hankintalain (1397/2016) liitteen E 1 kohdassa tarkoitettu sosiaali- ja terveyspalveluja koskeva hankinta [CPV-koodi; 85311300–5 Lasten ja nuorten sosiaalipalvelut], joten hankinnassa noudatetaan hankintalain 107 §:n mukaisia säännöksiä.,
