Scope overview
The New York City Department of Transportation (NYCDOT) intends to enter into negotiations with FLO Services USA Inc.
( FLO ) under the Negotiated Acquisition provision (Section 3-04) of the Procurement Policy Board Rules for an agreement to continue to operate and maintain the electrical vehicle service equipment ( EVSE ) at sites currently operating under the Curbside Level 2 Charging Pilot Program, a program initiated via a demonstration agreement between NYCDOT and Consolidated Edison Company of New York ( Con Edison ) that expires in July 2025.
FLO, under a separate agreement with Con Edison, is managing and operating the equipment at the Charger sites in the Pilot Program. Only FLO, which already has their EVSE installed and operating in situ, is in a position to offer continued operation in a way that is feasible until new EVSE installation and operation can be assumed under a new contract.
Accordingly, the Agency Chief Contracting Officer has determined that, pursuant to Section 3-04(b)(2)(i)D, there is a time sensitive situation where a vendor must be retained quickly because a compelling need for services exists that cannot be timely met through competitive sealed bidding or competitive sealed proposals and, pursuant to Section 3-04(b)(2)(ii), there is a limited number of vendors available and able to perform the work.
The term (duration) of this contract will be two (2) years (730 CCD). The projected start/end dates are 7/8/25 and 7/8/27, respectively.
