Notice of Award of a Memorandum of Agreement (Agreement) for the operation and management of a pedestrian plaza located at East 25th Street between Lexington and Third Avenues in Manhattan

DOTs Office of Cityscape & Franchises has awarded a Memorandum of Agreement (Agreement), pursuant to Section 1-16 of the Concession Rules of the City of New York, to The City University of New York on Behalf of Baruch College (Concessionaire), whose address is One Bernard Baruch Way, New York, NY 10010 to provide for the operation and management of a pedestrian plaza located at East 25th Street between Lexington and Third Avenues in Manhattan, New York (Plaza), and maintenance and/or repair of certain amenities installed within the Plaza, including through City-approved plaza events, sponsorships, gifts, and subconcessions. The term of the License will provide for one (1) five-year term, commencing upon written Notice to Proceed, with two (2) additional five-year renewal options, exercisable upon mutual consent of both parties; no leasehold or other propriety right will be offered. For compensation to the City, the concessionaire will be required to invest any revenue generated by this concession into the maintenance and/or repair of certain amenities within the Plaza, and reasonable administrative costs, as such costs relate to the Plaza.
