Scope overview
De marktbevragingsprocedure heeft betrekking op twee (2) percelen, m.n.: - Perceel 1 inzake de strandbarconcessies; - Perceel 2 inzake de kinderparkconcessies. Een Kandidaat kan slechts voor één (1) van de beide percelen een Voorstel indienen.
De procedure tot toewijzing van de Concessie(s) wordt gevoerd met toepassing van de beginselen van behoorlijk bestuur, zoals het transparantiebeginsel, het beginsel der eerlijke mededinging en het gelijkheidsbeginsel. De regels m.b.t. de toewijzing en uitvoering van de Concessie zijn vermeld in de Concessieleidraad en de daarbij gevoegde Bijlagen (de “Concessiedocumenten”).
De Concessie is niet onderworpen aan de Wet van 17 juni 2016 betreffende de concessieovereenkomsten, noch aan het Koninklijk Besluit van 25 juni 2017 betreffende de plaatsing en de algemene uitvoeringsregels van de concessieovereenkomsten, aangezien deze regelgeving niet van toepassing is op domeinconcessies. De Concessie is evenmin onderworpen aan de reglementering inzake overheidsopdrachten.
Ook de reglementering inzake handelshuur is niet van toepassing op onderhavige Concessie. Het betreft immers geen handelshuurovereenkomst.
